About the program:
ASEAN–Australia Counter Trafficking (ASEAN-ACT) continues Australia’s long running collaboration with ASEAN and its member states to end human trafficking in our region. The program will principally work on strengthening the justice sector response to human trafficking, while opening new partnerships with allied government agencies, civil society and business. It will engage all 10 ASEAN Member States in some capacity and will continue national-level programming in Cambodia, Indonesia, Lao PDR, Myanmar, the Philippines, Thailand and Vietnam.
The overarching goal that ASEAN-ACT will contribute to is that ASEAN member states have effective justice systems that provide just punishment of traffickers and protect the rights of victims. Three end-of-program outcomes (EOPOs) together contribute to the achievement of this goal by 2028:
> EOPO1: ASEAN’s planning, monitoring and reporting of ACTIP implementation is increasingly effective and advances the protection of victim rights.
> EOPO2: ASEAN member state justice and related state agencies are increasingly capable of implementing their ACTIP obligations, in particular those that uphold victim rights.
> EOPO3: ASEAN member state justice and related state agencies’ policies and practices are influenced by relevant stakeholders and better aligned with ACTIP, especially in connection to victim rights obligations.
During ASEAN-ACT’s Consultation Workshop on the Training of Trainers course development in 2020, law enforcement and prosecution agencies identified the need to strengthen the ability to deliver high quality trainings to achieve the outputs in Thailand’s national TIP strategy.
To deliver this support in a sustainable manner ASEAN-ACT will work with the Department of Trafficking in Persons Litigation of Office of the Attorney General (DTIPL) and the Public Prosecution Official Training Institute to build a core group of prosecutor-trainers to deliver capacity building programs on Counter Trafficking in Persons (CTIP) for prosecutors.
Working under the supervision of the Counter Trafficking in Persons Training Lead Consultant and in close cooperation with ASEAN-ACT’s Country Manager – Thailand and the ASEAN-ACT team, the Consultant will develop an integrated and comprehensive counter trafficking in persons (TIP) curriculum and modules for the DTIPL, based on existing materials and reference documents and in consultation with DTIPL, Public Prosecution Official Training Institute and ASEAN-ACT to suit the requirements of the DTIPL. The materials are expected to vary in length.
Prosecutors in the Department of Trafficking in Persons Litigation and prosecutors who will provide training on investigating and prosecuting human trafficking cases.
Areas of Responsibility
The consultant will work under the supervision of the Counter Trafficking in Persons Training Lead Consultant and in close consultation with the Country Manager – Thailand, DTIPL, Public Prosecution Official Training Institute and ASEAN-ACT team. They will be responsible for undertaking preparatory meetings, including consultations as required, which may include but are not limited to:
> Consultations with DTIPL and Public Prosecution Official Training Institute to develop the write shop details, mechanics and flow.
> Consultations with DTIPL and the Public Prosecution Official Training Institute on the development of the training materials - both the participants’ manuals and trainers’ manuals.
> Consultations with ASEAN-ACT team members.
Supporting the development of methodology, design, and facilitation of write shops/workshops to be held on agreed dates, including but not limited to:
> Observe timing of the processes
> Preparation of PowerPoint presentations for the write shop
> Documentation, collection, and collation of outputs
> Analysis of outputs.
Specifically, the Consultant Team shall deliver to the Program the final form of the following:
> Trafficking in persons prosecutorial training curriculum
> Training manual for trainers with associated PowerPoint presentations per session
> Training manual for participants
In developing the above final outputs, the Consultant Team shall:
> Review the existing police and prosecutor handbooks to develop training manuals to address the capacity development needs of DTIPL;
> Incorporate evidential issues on online sexual exploitation of children and on money laundering dimensions relating to TIP in the manuals;
> Incorporate basic to intermediate level concepts on cybercrime investigations and prosecution in the manuals;
> Incorporate appropriate adult learning principles in the training program.
> Incorporate ASEAN context and the ASEAN Convention on Trafficking in Persons, Especially of Women and Children (ACTIP) in the manuals;
> Incorporate identified emerging TIP issues in the manuals;
> Incorporate “learning by doing” activities in the training program;
> Incorporate victim-centric and human rights-based approaches in trafficking investigations and prosecution; including gender sensitive, social inclusion and victim rights principles, as well as principles on trauma-informed care and child-sensitive handling of minors in TIP cases;
> Preferably, provide required and new knowledge to DTIPL to encourage acceptance of necessary changes and processes advised by the ASEAN-ACT team;
> Demonstrate curriculum and program development to DTIPL to increase their capacity to development curriculum;
> Ensure Thailand references and terms are appropriate for the specific relevant contexts; and
> Incorporate other areas which may later be identified.
The following should be conducted within the timeline:
> Consultations and meetings with DTIPL, Public Prosecution Official Training Institute and ASEAN-ACT, as required.
> Two 3-day write shops on the development of the DTIPL training program on TIP.
> 1-day validation workshop prior to the final submission.
> Electronic and ready-to-print/publication-ready copies of the following:
> Trafficking in persons prosecutorial training curriculum.
> Training manual for trainers with associated PowerPoint presentations per session.
> Training manual for participants.
> Demonstrated expertise in curriculum development;
> Ability to work with senior government officials, especially those in the justice agencies;
> Demonstrated knowledge in developing, conducting and facilitating training programs;
> Demonstrated competence in conducting and facilitating consultations, workshops and trainings;
> Extensive background in criminology and TIP in Thailand context; and
> Ability to produce high quality written materials including reporting both in Thai and English.
> Well-established network in the Thai justice sector;
> Background knowledge of Thai criminal justice system;
> Extensive experience in working with international development partners; and
> Skills in the editing and formatting of document to a high standard, especially official or legal documents.
