About the Role
we're seeking an experienced Legal Counsel with demonstrated, hands-on experience drafting, reviewing and negotiating both construction works contracts and hire contracts. This role will support major projects and business operations across Australia and New Zealand.

This is a hands-on role requiring the successful candidate to manage these contracts independently from commencement. It will best suit a commercially minded lawyer who can quickly identify material risks, propose workable positions and support the business through negotiation and project delivery

Reporting to the Deputy General Counsel, you join a collaborative APAC legal team and work closely with senior leaders, sales, operations, project delivery, procurement and finance.

Based at our National Office in Redbank, this 6-month contract role offers flexibility through a hybrid work week, with 3 days in the office and 2 days working from home with the opportunity to become permanent.

You will:

• Independently draft, review and negotiate construction works contracts, including design and construct contracts, construct-only contracts, subcontracts, consultancy agreements and related project documents.
• Independently draft, review and negotiate hire contracts for modular buildings, plant, equipment or other commercial assets, including terms dealing with delivery, installation, maintenance, damage, variations, minimum hire periods, termination, removal and risk allocation.
• Review tenders and prepare practical contract risk assessments, departures and negotiation strategies.
• Advise project and operational teams on contract administration issues, variations, extensions of time, delay, defects, payment, security, indemnities, insurance, limitations of liability and termination rights.
• Support contract disputes, claims and early resolution strategies.
• Provide practical advice on commercial arrangements, property, the Personal Property Securities Act, competition and consumer law, compliance and other day-to-day legal matters.
• Work with stakeholders to identify and manage legal and commercial risk without unnecessarily delaying business outcomes.
• Liaise with clients, external counsel, insurers, government authorities and other key stakeholders.
• Contribute to legal and commercial training and the continuous improvement of contract templates, playbooks and processes.

  
About You:

• A tertiary qualification in law and admission to practice in Queensland (or immediate eligibility for admission).
• 4+ years' post admission experience (PAE) in construction and commercial contracting gained in private practice, in-house or a combination of both.
• Substantial recent experience independently drafting, reviewing and negotiating construction works and commercial hire contracts (general leasing experience alone will not satisfy this requirement).
• Experience advising a contractor, supplier, hirer or service provider operating in the construction, modular building, plant or equipment hire, engineering, mining services or infrastructure sectors.
• A sound working knowledge of construction contract risk and contract administration, including variations, delay, defects, payment, indemnities, insurance, liability caps and termination.
• The ability to work autonomously, manage competing priorities and give clear, practical advice to non-legal stakeholders.
• Strong drafting, negotiation, communication and stakeholder management skills, together with sound commercial judgement.
